Terms of Service

1. Parties and scope

These Terms govern your use of Lohelo (the Android app, the iPhone app Lohelo Pocket with its keyboard, and the desktop app) and the related services at lohelo.com and api.wovero.com (together, the "Service"), provided by Wovero GmbH, Badestube 6, 36251 Bad Hersfeld, Germany, registered with the Amtsgericht Bad Hersfeld under HRB 3405 (see Imprint) ("we", "us"). By using the Service you agree to these Terms.

2. Account and eligibility

You must be 18 or older. You sign in with an email code, or with Google or Apple. You are responsible for your sign-in and for all activity under your account. How we handle your data is described in the Privacy Policy, which forms part of these Terms. Lohelo is in a testing phase and features can change.

3. Plans

Free: up to 2,000 dictated words per week. Lohelo Pro: a paid subscription without that limit, available monthly or yearly. The price is shown in the store, or before you pay on the web, in your currency and including any applicable VAT. We may change the Free plan and prices for the future; a price change does not apply to a running subscription period, and for existing subscribers it takes effect only after the notice the store or the law requires.

4. Subscription and auto-renewal

Lohelo Pro renews automatically for the same period (month or year) at the then-current price until you cancel. You can cancel at any time; the cancellation takes effect at the end of the paid period, and you keep Pro until then.

• Bought in the iPhone app: Apple charges you and manages the subscription. Cancel in Settings → your name → Subscriptions on your iPhone, or in the App Store. Apple's terms apply; refunds are handled by Apple.
• Bought in the Android app: Google Play charges you and manages the subscription. Cancel in the Play Store → Profile → Payments and subscriptions → Subscriptions. Google's terms apply; refunds are handled by Google.
• Bought on the web: Stripe processes the payment. Cancel in the billing portal in Settings → Account in the app, or write to support@wovero.com.

Deleting your Lohelo account or the app does not cancel a subscription. Cancel it in the store or portal where you bought it.

5. Right of withdrawal (EU consumers)

If you buy directly from us on the web as a consumer in the EU, you have a 14-day right of withdrawal under Art. 246a § 1 (2) no. 1 EGBGB. You lose it if we start the service at your request within those 14 days and you have confirmed that you know this (§ 356 (5) BGB). For purchases through Apple or Google, their withdrawal and refund rules apply. To withdraw, write to support@wovero.com.

6. Acceptable use

You agree not to use the Service to:

• Record or transcribe people without the consent that the law requires
• Generate or reshape illegal, defamatory or hateful content
• Reverse-engineer, scrape or attempt to extract our prompts, model outputs at scale or proprietary code
• Resell access to Lohelo or expose its API to third parties without a written agreement

7. Service availability

We aim for high availability but do not guarantee uninterrupted Service. Maintenance, outages at our infrastructure or providers, or force majeure may cause downtime. Speech recognition can make mistakes: check important text before you send it.

8. Liability

We are liable without limit for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation and only for the typical, foreseeable damage. Otherwise liability is excluded. The Free plan is provided free of charge, with the liability that German law sets for gifts.

9. Termination

You can stop using Lohelo and delete your account at any time (how). We may suspend or end your account if you materially breach these Terms, after notice and a reasonable period to fix it unless the breach cannot be fixed.

10. Updates

We update Lohelo from time to time. Updates may add, change or remove features.

11. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only to the extent that mandatory consumer law of your country of residence does not give you more protection. For merchants the place of jurisdiction is Bad Hersfeld.

12. Changes to these Terms

We may update these Terms for new features, legal requirements or pricing changes. We tell you about material changes in the app or by email at least 30 days before they take effect. If you do not agree, you can end your subscription and delete your account before then.
